Welcome to Kaia Patterns.

These Terms of Service ("Terms") govern your access to and use of kaiapatterns.com (the "Website") and the products, digital content, features, services, and other offerings provided by Kaia Patterns ("Kaia Patterns," "Kaia," "we," "us," or "our").

By accessing the Website, creating an account, purchasing or downloading a pattern, using a free pattern, submitting information to us, or otherwise using our Services, you agree to these Terms.

If you do not agree to these Terms, please do not use the Website or our Services.

1. About Kaia Patterns

Kaia Patterns is a sewing-pattern business based in Denver, Colorado, United States.

We provide digital sewing patterns and related materials, which may include:

• downloadable PDF sewing patterns;
• A0 large-format pattern files;
• A4 and/or US Letter print-at-home pattern files;
• sewing instructions;
• cutting guides;
• technical illustrations;
• size and measurement information;
• fabric and material recommendations;
• pattern variations;
• adaptive or customized pattern services;
• free patterns and resources; and
• other sewing-related digital content.

Unless expressly stated otherwise, products sold through Kaia Patterns are digital sewing patterns and related digital materials, not finished garments.

2. Eligibility

You must be legally capable of entering into a binding agreement to use our Services.

If you are under the age of majority where you live, you may use our Services only with the involvement and permission of a parent or legal guardian.

By using the Services, you represent that you meet these requirements.

3. Accounts

Certain features may require you to create an account.

You agree to provide accurate and current information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You may not:

• share an account for the purpose of avoiding purchasing additional licenses;
• access another person’s account without permission;
• create accounts using false or misleading information;
• use automated systems to create accounts or abuse promotions; or
• attempt to circumvent account restrictions.

Please contact us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate accounts reasonably believed to be involved in fraud, abuse, unauthorized redistribution, security threats, or violations of these Terms.

4. Digital Products

Kaia Patterns primarily sells digital products.

After purchasing a digital product, you may receive access through one or more methods, including:

• direct download;
• your Kaia Patterns account;
• email;
• PDF attachment;
• download link; or
• another electronic delivery method.

Kaia Patterns products are digital products. Nothing is physically shipped: no physical garment, printed pattern, or other physical item is included with a purchase.

The appearance of a garment in photographs, illustrations, renderings, technical drawings, simulations, or promotional material may vary from a finished garment made by a customer.

5. Product Information

We aim to provide useful and accurate information regarding each pattern, including where applicable:

• available sizes;
• body measurements;
• finished garment measurements;
• recommended fabrics;
• fabric requirements;
• difficulty level;
• required notions;
• pattern pieces;
• printing formats; and
• sewing instructions.

However, sewing involves many variables outside our control. These may include fabric selection, fabric stretch, fabric shrinkage, printer settings, printing accuracy, cutting accuracy, body measurements, sewing technique, seam allowances, equipment, alterations, construction choices, and individual fit preferences.

You are responsible for reviewing the product information and determining whether a pattern is appropriate for your intended project.

6. Pricing

Prices are displayed on the Website before purchase.

We may change prices at any time.

A price change does not affect a purchase that has already been completed.

Prices may be displayed in U.S. dollars or another currency depending on Website functionality and customer location.

Applicable taxes may be added where required by law.

7. Payment

Payments may be processed by third-party payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method.

You authorize us and our payment processors to charge the applicable purchase price, taxes, and any other clearly disclosed charges.

We do not necessarily receive or store complete payment-card information. Transactions may be subject to additional terms imposed by the relevant payment processor or financial institution.

8. Promotions and Discounts

We may offer:

• discount codes;
• free patterns;
• introductory offers;
• referral benefits;
• promotional credits;
• bundles; or
• other promotions.

Unless otherwise stated, promotions:

• have no cash value;
• cannot be combined with other offers;
• may be limited to one per customer;
• may have eligibility requirements; and
• may be modified or discontinued where permitted by law.

We may cancel promotional benefits obtained through fraud, duplicate accounts, manipulation, automated systems, or other abuse.

9. Digital Delivery

Because our primary products are digital, delivery generally occurs electronically. You are responsible for providing a valid email address and maintaining access to the email address and/or account associated with your purchase.

If you experience a technical problem accessing a purchased file, please contact us and we will make reasonable efforts to restore access or provide the file.

10. Refunds

Due to the nature of downloadable digital products, sales of digital patterns are generally final once the digital product has been delivered, accessed, or downloaded, except where a refund is required by applicable law.

However, we want customers to receive the product they purchased.

Please contact us if:

• you were charged more than once for the same transaction;
• you purchased the same pattern twice accidentally;
• you received the wrong file;
• a purchased file is corrupted or cannot reasonably be used;
• the product materially differs from its description; or
• another significant technical issue prevents you from accessing your purchase.

Where appropriate, we may provide a replacement file, corrected version, store credit, refund, or another reasonable remedy.

Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

11. Pattern Updates and Corrections

We may periodically:

• correct errors;
• improve instructions;
• update pattern pieces;
• modify layouts;
• improve grading;
• revise technical information; or
• release new versions of patterns.

A pattern’s Pattern ID, version number, or similar identifier may be used to distinguish versions.

Where reasonably practicable, customers who previously purchased a pattern may receive access to an updated version.

However, purchasing a pattern does not guarantee access to every future redesign, expansion, variation, size range, or separately released edition of that pattern.

12. Ownership

Unless otherwise stated, Kaia Patterns and/or its licensors own the intellectual property rights in the Website and Kaia Patterns materials, including:

• sewing patterns;
• pattern pieces;
• pattern geometry;
• grading;
• technical drawings;
• illustrations;
• instructions;
• written content;
• photographs;
• graphics;
• branding;
• logos;
• Website design;
• downloadable files;
• product descriptions;
• databases;
• software; and
• other original content.

Purchasing or downloading a pattern does not transfer ownership of the pattern or its intellectual property rights to you.

Instead, you receive a limited license to use the pattern according to these Terms.

13. Personal-Use License

Unless a product page or separate license expressly states otherwise, purchasing or legitimately obtaining a Kaia Patterns sewing pattern gives you a limited, non-exclusive, non-transferable, revocable license to:

• download the pattern;
• store reasonable personal backup copies;
• print the pattern for your own use;
• modify the pattern for your own sewing projects; and
• sew garments or other items from the pattern for personal use.

You may print copies reasonably necessary for your personal sewing projects.

14. Small-Scale Commercial Use

Unless a particular product states otherwise, you may use a legitimately obtained Kaia Patterns pattern to personally produce finished physical items for small-scale commercial sale.

This permission applies to finished physical products only.

It does not give you permission to sell, sublicense, distribute, or commercially exploit the pattern itself.

You may not represent a Kaia Patterns pattern as a pattern you designed yourself.

Mass manufacturing, factory production, large-scale commercial production, print-on-demand manufacturing based on our pattern designs, or licensing the designs to a manufacturer requires our prior written permission.

15. Prohibited Use of Patterns

You may not, without our prior written permission:

• sell a Kaia Patterns pattern file;
• redistribute a pattern file;
• upload a pattern to another website;
• upload a pattern to a file-sharing service;
• share purchased pattern files publicly;
• provide copies to customers or other businesses;
• include our pattern files in bundles or collections;
• resell printed copies of our patterns;
• sublicense our patterns;
• claim authorship of our patterns;
• remove copyright, Pattern ID, version, or ownership notices for redistribution;
• reproduce substantial portions of our instructions for publication;
• create substantially identical pattern files for redistribution;
• use our files to operate a competing pattern-download library; or
• otherwise commercially exploit our digital pattern files except as expressly permitted by these Terms.

Purchasing one copy does not give you the right to redistribute unlimited copies.

16. Sewing Classes and Groups

A purchased pattern license generally applies to the individual purchaser.

If a sewing teacher, school, workshop, club, business, or organization wants to distribute pattern copies to multiple participants, each participant must have an appropriately licensed copy unless Kaia Patterns has granted written permission for group use.

Teachers may demonstrate techniques using a legally obtained pattern but may not distribute unauthorized copies of the pattern files.

17. Copyright

Unless otherwise indicated:

Individual pattern files may also contain Pattern IDs, version numbers, copyright notices, and other identifiers.

You may not intentionally remove these identifiers from copies being distributed in violation of these Terms.

18. Trademarks

Kaia Patterns, Kaia branding, logos, product branding, and related marks may be trademarks or trade dress belonging to Kaia Patterns.

Nothing in these Terms grants you a license to use our branding in a manner that suggests sponsorship, affiliation, endorsement, or authorization where none exists.

19. Printing Accuracy

Many Kaia Patterns products are designed to be printed at a specified scale.

You are responsible for:

• selecting the correct paper size;
• following printing instructions;
• disabling inappropriate "fit to page" scaling where instructed;
• confirming the print scale;
• measuring any included test square;
• assembling tiled pages correctly; and
• verifying dimensions before cutting fabric.

We strongly recommend verifying the test square or other scale indicator before printing an entire pattern or cutting fabric.

Kaia Patterns is not responsible for fabric, printing, or other costs resulting from incorrectly scaled printing where the supplied file itself is accurate.

20. A0 and Third-Party Printing

A0 and other large-format files may be printed using third-party printing services.

Kaia Patterns is not responsible for errors introduced by a third-party printer, including:

• incorrect scaling;
• cropping;
• paper substitution;
• print distortion;
• shipping damage; or
• incorrect printer settings.

You should verify printed measurements before cutting fabric.

21. Fit

Body shapes and proportions vary significantly.

Size charts and finished garment measurements are guides and do not guarantee a particular fit.

Depending on the garment and your preferences, alterations may be necessary. We recommend reviewing the size chart and finished measurements before cutting fabric and, where appropriate, making a test garment or toile/muslin.

22. Fabric and Materials

Fabric behavior varies based on characteristics including: fiber, weave or knit structure, stretch, recovery, weight, drape, shrinkage, finishing, washing, and manufacturing variation.

Recommended fabrics are guidance rather than a guarantee that every fabric within a category will produce identical results.

23. Sewing Safety

Sewing may involve equipment and tools capable of causing injury, including: sewing machines, overlockers/sergers, needles, pins, scissors, rotary cutters, irons, steam, cutting equipment, and other tools.

You are responsible for using appropriate safety precautions and following equipment manufacturers’ instructions.

Children should use sewing tools and equipment only with appropriate adult supervision.

24. Adaptive Services

Kaia Patterns may offer free or paid services designed to modify, adapt, or customize patterns for customers with particular fit, mobility, accessibility, or clothing requirements.

These services may rely on information provided by the customer.

The customer is responsible for providing measurements and other relevant information accurately.

Adaptive or customized patterns may require additional fitting or alteration after construction.

25. No Medical Services

Kaia Patterns provides sewing and garment-pattern services.

We do not provide medical, occupational therapy, physical therapy, rehabilitation, prosthetic, orthopedic, or other healthcare services.

Information relating to adaptive garments is provided for sewing and clothing purposes and is not medical advice.

If a garment must accommodate a medical device, prosthesis, mobility device, wound, physical restriction, or other health-related requirement, the customer is responsible for determining whether the garment is safe and appropriate for their circumstances and obtaining professional advice where necessary.

26. Technology-Assisted Production

Kaia Patterns may use software, algorithms, computer-aided design systems, automated systems, artificial intelligence, machine learning, simulation, or other technology to assist with aspects of our business.

These technologies may assist with activities including: design development, pattern generation, grading, layout optimization, technical illustration, quality assurance, pattern verification, product imagery, written content, sewing instructions, and customer support.

Technology-assisted content may also be reviewed, tested, edited, or validated through automated and/or human processes.

Use of these technologies does not change the license restrictions applicable to Kaia Patterns products.

27. Pattern Accuracy

We aim to provide accurate, usable sewing patterns.

However, no sewing pattern or digital production process can be guaranteed to be completely free from errors.

Possible issues may include errors involving: pattern markings, notches, labels, instructions, grading, seam relationships, layout, file formatting, measurements, or other technical elements.

If you believe a Kaia Patterns product contains an error, please contact us with the Pattern ID, version number, and a description of the issue. We may investigate and, where appropriate, issue a correction or updated file.

28. User Submissions

You may be able to submit information such as: reviews, feedback, fit notes, measurements, alteration requests, suggestions, photographs, completed-project images, survey responses, or other content.

You retain ownership of content you own.

By submitting content specifically for publication, display, promotion, product improvement, or community use, you grant Kaia Patterns a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content for the purposes reasonably associated with the submission and operation or promotion of Kaia Patterns.

This license does not transfer ownership of your content to us.

Where practicable, you may contact us if you would like us to stop using your content in future promotional materials.

29. Reviews

Customers are free to provide honest reviews and feedback regarding Kaia Patterns and their experiences with our products.

Nothing in these Terms is intended to prohibit or penalize honest consumer reviews. We may moderate content hosted on our own Website that is unlawful, fraudulent, abusive, unrelated, spam, infringes third-party rights, contains personal information, or otherwise violates reasonable community standards.

30. Feedback and Suggestions

If you voluntarily provide suggestions, ideas, feature requests, or general feedback about improving Kaia Patterns, we may use that feedback without obligation to compensate you.

This does not give us ownership of sewing patterns, artwork, photographs, or other original works you separately submit unless otherwise agreed in writing.

31. Acceptable Use

You may not:

• use the Website for unlawful purposes;
• interfere with Website security;
• introduce malware or malicious code;
• attempt unauthorized access to accounts or systems;
• circumvent technological restrictions;
• conduct fraudulent transactions;
• scrape the Website at a scale that materially interferes with its operation;
• use bots to abuse promotions or purchasing systems;
• impersonate another person;
• harvest personal information;
• use the Website to infringe intellectual property rights; or
• use the Services in a manner that materially disrupts other users.

32. Automated Access and Datasets

Unless expressly authorized by us in writing, you may not systematically download, scrape, crawl, reproduce, or extract substantial portions of the Kaia Patterns catalog, Website, pattern library, images, product information, pattern files, or databases for the purpose of:

• creating a competing database;
• redistributing our catalog;
• training or developing a competing commercial pattern-generation system;
• reproducing our pattern library;
• creating derivative commercial datasets; or
• circumventing normal Website access controls.

This section does not restrict activities that cannot lawfully be restricted under applicable law.

33. Third-Party Services

Our Website may integrate or link to third-party services such as:

• payment processors;
• email providers;
• analytics providers;
• social networks;
• printing services;
• hosting providers; or
• other websites.

We do not control third-party services and are not responsible for their independent content, policies, availability, security, or conduct. Your use of third-party services may be subject to their own terms and privacy policies.

34. Subscriptions

Kaia Patterns may offer subscriptions or memberships in the future.

If we offer an automatically renewing subscription, the price, billing frequency, renewal terms, cancellation policy, and other material terms will be disclosed before purchase.

By purchasing an automatically renewing subscription, you authorize recurring charges according to the terms presented at checkout until cancellation.

Where required by applicable law, we will provide renewal notices and appropriate cancellation mechanisms.

If a subscription is purchased online and applicable law requires online cancellation, an online cancellation method will be made available.

Subscription-specific terms presented at the time of purchase form part of these Terms.

35. Website Availability

We aim to keep the Website and purchased content reasonably accessible but cannot guarantee uninterrupted availability.

Access may temporarily be unavailable because of: maintenance, updates, technical failures, security incidents, third-party outages, or circumstances outside our reasonable control.

36. Product Discontinuation

We may discontinue products or services.

Where reasonably practicable, we may continue allowing previous purchasers to access previously purchased digital files, but permanent hosting or lifetime cloud access is not guaranteed unless expressly promised.

We recommend keeping personal backup copies of purchased pattern files.

Your license to a legitimately downloaded pattern does not automatically end merely because the product is later removed from sale.

37. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, SERVICES, PATTERNS, AND DIGITAL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

KAIA PATTERNS DISCLAIMS WARRANTIES THAT MAY OTHERWISE ARISE BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT:

• EVERY PATTERN WILL REQUIRE NO ALTERATION;
• EVERY GARMENT WILL FIT EVERY BODY TYPE;
• EVERY FABRIC WILL PRODUCE IDENTICAL RESULTS;
• THE WEBSITE WILL ALWAYS BE AVAILABLE;
• EVERY FILE WILL BE COMPLETELY FREE FROM ERROR; OR
• A CUSTOMER’S FINISHED ITEM WILL IDENTICALLY MATCH PHOTOGRAPHS, ILLUSTRATIONS, RENDERINGS, OR EXAMPLES.

Nothing in this section excludes warranties or rights that cannot legally be excluded.

38. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAIA PATTERNS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW: lost profits, lost business opportunities, loss of data, wasted materials, fabric costs, printing costs, third-party printing costs, or losses resulting from use of a pattern contrary to its instructions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAIA PATTERNS’ AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE OR PRODUCT WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO KAIA PATTERNS FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE CLAIM; OR

(B) US $100.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

39. Non-waivable rights

Nothing in these Terms is intended to:

• exclude liability that cannot legally be excluded;
• waive mandatory consumer-protection rights;
• restrict lawful consumer reviews;
• prevent you from reporting unlawful conduct to a government authority; or
• limit rights that applicable law does not permit you to waive.

40. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Kaia Patterns and its owners, officers, employees, contractors, and affiliates from third-party claims, liabilities, damages, and reasonable expenses arising from:

• your unlawful use of the Services;
• your unauthorized redistribution of our intellectual property;
• your infringement of another person’s rights; or
• your material violation of these Terms.

This provision does not require a consumer to indemnify Kaia Patterns for Kaia Patterns’ own unlawful conduct, negligence where such indemnification is prohibited, or other liability that cannot lawfully be shifted.

41. Termination by you

You may stop using the Services at any time.

Where account deletion functionality is available, you may request deletion subject to applicable recordkeeping, fraud-prevention, legal, and transactional requirements.

Deleting your account does not automatically entitle you to refunds for previously purchased digital products.

42. Termination by Kaia Patterns

We may suspend or terminate access where reasonably necessary because of: material violation of these Terms, fraud, unauthorized distribution of patterns, intellectual-property infringement, security threats, unlawful conduct, or abuse of the Website or Services.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to remedy the violation.

Termination does not eliminate obligations or rights that by their nature should survive termination, including intellectual-property restrictions and applicable payment obligations.

43. Contact us first

If you have a problem with a purchase or the Services, we encourage you to contact us first.

Many problems involving downloads, printing, pattern versions, payments, or files can be resolved without a formal dispute.

44. Governing law

These Terms and disputes arising from them are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your jurisdiction apply regardless of this provision.

45. Venue

Subject to applicable law and any valid arbitration agreement separately accepted by the parties, legal proceedings arising from these Terms may be brought in the state or federal courts having jurisdiction in Denver, Colorado.

You and Kaia Patterns consent to the jurisdiction of those courts to the extent permitted by applicable law.

This provision does not prevent a consumer from exercising rights that applicable law requires to be available in another jurisdiction.

46. Informal dispute resolution

Before filing a lawsuit concerning these Terms, you and Kaia Patterns agree to make a reasonable good-faith effort to resolve the dispute informally.

A party seeking to initiate a dispute should provide the other party with a written description of:

• the issue;
• relevant transaction information;
• the requested resolution; and
• reasonable supporting information.

This provision does not prevent either party from seeking urgent injunctive relief where appropriate or using a small-claims process where available.

47. Changes to these terms

We may update these Terms from time to time.

When we do, we will update the "Last Updated" date.

For material changes, we may provide additional notice where required by law.

Changes apply prospectively from their effective date unless applicable law permits otherwise.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms where permitted by law.

48. Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.

49. No waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

50. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent.

We may assign these Terms as part of a merger, acquisition, corporate reorganization, sale of assets, or similar business transaction, subject to applicable law.

51. Headings

Section headings are included for convenience and do not affect interpretation of these Terms.

52. Entire agreement

These Terms, together with policies and terms expressly incorporated by reference, constitute the agreement between you and Kaia Patterns concerning your use of the Services.

Additional terms presented for a particular product, promotion, subscription, or service may supplement these Terms.

If specific additional terms conflict with these Terms, the specific terms govern with respect to the applicable product or service.

53. Electronic communications

You agree that communications relating to transactions and your use of the Services may be provided electronically, including through email or the Website, where permitted by law.

You are responsible for maintaining a current email address associated with your account.

Marketing communications are subject to applicable law and any unsubscribe rights provided in those communications.

54. Privacy

Our collection and use of personal information is governed by our separate Privacy Policy.

The Privacy Policy should be reviewed together with these Terms.

55. Accessibility

Kaia Patterns aims to make its Website and products accessible to a broad range of customers.

If you encounter difficulty accessing Website content or a digital product because of an accessibility issue, please contact us so that we can determine whether a reasonable alternative format or solution is available.
